6. Intellectual property

Your content: You retain full ownership of any content you create, upload or generate through Orkly. By using the service, you grant us a limited, non-exclusive licence to process and store your content solely to provide the service.

Orkly's IP: All software, design, branding and functionality of Orkly is owned by Jorge Carlos Vinagre Triguero and protected by applicable intellectual property law. You may not copy, modify, distribute or create derivative works without our express written permission.

Open-source components: Orkly's source code is licensed under GNU AGPLv3 with Commons Clause. Commercial use without a licence is prohibited. See the repository for details.

Orkly is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the service will be uninterrupted, error-free or free of viruses or other harmful components.

11. Limitation of liability

To the maximum extent permitted by applicable law, Jorge Carlos Vinagre Triguero shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of or inability to use Orkly.

Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim, or €50, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.

These Terms are governed by the laws of Spain and, where applicable, European Union law. Any disputes arising from these Terms or your use of Orkly shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to your rights as a consumer under applicable EU law.
